Makhee Solutions Terms and Conditions

Makhee Solutions ("we," "us," or "our") provides its services through its website and mobile applications (collectively referred to as the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, which includes features such as classified ads, business listings, network marketing, and related services. By using the Platform, you agree to be bound by these Terms.

1. Definitions

• Platform: Refers to the website www.makhee.com and any related services provided by Makhee Solutions (Pty) Ltd.
• User: An individual or business who registers on the platform to access services such as classified ads, business listings, and network marketing.
• Free Subscription Plan: The default plan upon registration, which provides limited access to the platform.
• Starter Plan: A paid plan that gives full access to the platform, including all services.

2. Account Registration and Access

To use our services, you must register for an account on the Platform. Upon registration, all members receive free subscription access, which provides limited features, such as the ability to post business listings and classified ads. Full access to all services, including network marketing opportunities, requires an upgrade to the Starter Plan for a one-time fee of R150, granting you access to all features and benefits for a lifetime.

Free Subscription Plan:

• Business Listings: Limited access to add and manage business listings.
• Classified Ads: Limited access to post and view classified ads.

Starter Plan (R150 one-time payment):

• Full Access: Access to all features, including classified ads, business listings, and network marketing tools.
• Lifetime Subscription: The Starter Plan is a one-time fee, and access is valid for the lifetime of your membership.

3. Content Ownership and Use

You retain ownership of the content you submit to the Platform, including your business listings, classified ads, and network marketing details. However, by submitting content, you grant Makhee Solutions a non-exclusive, royalty-free license to use, display, modify, and distribute your content for the purpose of promoting your listing and services on the Platform.

4. User Conduct

By accessing the Platform, you agree to adhere to the following guidelines:

• Legal Compliance: You will comply with all applicable laws when posting content or engaging with other users on the Platform.
• Respectful Behavior: You will not engage in abusive, discriminatory, or harmful behavior toward other users or staff.
• Prohibited Content: You agree not to submit or share any content that:
  • Violates any laws or regulations.
  • Promotes illegal, fraudulent, or deceptive practices.
  • Contains offensive, harmful, or abusive content, including pornography, hate speech, and violence.
  • Promotes prohibited goods or services, including drugs, weapons, or counterfeit items.

5. Content Moderation and Approval

All classified ads and business listings submitted to the Platform will be reviewed and approved by Makhee Solutions' Admin Team within 24 hours of submission.

• Content Guidelines: The content you post must comply with the Platform's standards. Ads or listings that violate these standards will be rejected or removed.
• Approval Process: After submission, our admin team will review each listing within 24 hours and either approve or reject it. If your content is rejected, you will receive a notification with an explanation of the reason.

6. Content Moderation & Approval

Prohibited Content

Makhee Solutions will not approve or allow content that:

• Illegal Activities: Advertisements or listings promoting illegal activities, including the sale or distribution of counterfeit goods, prohibited items, or anything that violates local, national, or international laws.
• Drugs and Controlled Substances: Listings promoting or selling illegal drugs, narcotics, prescription medication without a prescription, or any controlled substances.
• Pornography and Adult Content: Explicit sexual content, pornography, adult material, or anything sexually suggestive or obscene in nature.
• Weapons and Ammunition: Listings for firearms, explosives, ammunition, or other dangerous weapons, including illegal or unregulated items.
• Hate Speech, Harassment, and Discrimination: Content that promotes hate speech, discrimination, harassment, or violence against individuals or groups based on race, religion, gender, sexual orientation, disability, or other protected categories.
• Violence, Threats, and Abuse: Content that promotes violence, threats, intimidation, or abuse against individuals or groups. This includes inciting harm or harm-related activities.
• Scams, Fraud, and Misrepresentation: Advertisements or listings that are deceptive, fraudulent, or part of a scam, such as pyramid schemes, phishing attempts, or misleading claims about products or services.
• Unlicensed Medical Services: Listings offering unlicensed medical or healthcare services, making false or unverified medical claims, or related to the unauthorized practice of medicine.
• Terrorism and Extremist Content: Content that promotes or encourages terrorism, extremism, or any activities that incite harm to individuals, groups, or society.
• Child Exploitation or Abuse: Content that exploits or abuses children, minors, or vulnerable individuals in any form.
• Unlawful Services: Advertisements promoting illegal services, including unlicensed gambling, illicit financial services, or any service that violates laws or regulations.
• Misleading or False Advertising: Listings that contain false, misleading, or inaccurate information, or those that misrepresent products, services, businesses, or individuals.

7. Payment Terms

When you choose to upgrade to the Starter Plan, the payment of R150 is a one-time fee, providing you with lifetime access to all services offered on the Platform.

Payment Methods:

• Credit/Debit Card (via our secure online payment gateway)
• EFT (Electronic Funds Transfer): Payments can also be made via EFT to Makhee Solutions' designated bank account. Please contact our support team at info@makhee.com for EFT payment details.

Important: If you choose to pay via EFT, your account will be activated once we have received confirmation of the payment. This may take up to 1-2 business days. Please ensure you reference your registration details when making the payment to ensure we can correctly allocate the funds to your account.

Refunds: Payments for the Starter Plan are non-refundable. Please ensure you fully understand the services included before making the payment.

8. Privacy and Data Protection

We are committed to protecting your privacy. Please refer to our Privacy Policy for information about how we collect, use, and protect your personal data. By using the Platform, you consent to the collection and use of your personal information in accordance with our Privacy Policy.

9. Termination of Account

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or post prohibited content. If your account is terminated, you will lose access to all services, and any content you have posted may be removed from the Platform.

10. Liability Limitations

Makhee Solutions will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability is limited to the amount paid by you for the services in question.

11. Indemnification

You agree to indemnify and hold harmless Makhee Solutions, its directors, employees, affiliates, and partners from any claims, damages, or liabilities arising out of your use of the Platform or violation of these Terms.

12. Modifications to the Terms

Makhee Solutions reserves the right to modify or update these Terms at any time. Any changes will be posted on this page, and your continued use of the Platform after such changes indicates your acceptance of the updated Terms.

13. Governing Law

These Terms will be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.
